1. Agreement to these Terms
Panderr is a product and service operated by PeachSites, LLC
(“PeachSites,” “we,” “us,” or “our”). References to “Panderr” in these
Terms refer to the Panderr platform, website, software, products, and
services provided by PeachSites, LLC.
By accessing or using Panderr, creating an account, submitting a
website or files, purchasing a Panderr product or service, or using
Panderr to migrate, create, edit, export, or publish a website, you
agree to these Terms of Service.
If you do not agree to these Terms, you should not use Panderr.
2. Using Panderr
You may use Panderr only in compliance with these Terms and applicable
law.
You are responsible for the information, website URLs, website
content, files, assets, account information, credentials, project
information, and instructions you provide through Panderr.
You must provide accurate information when creating or managing an
account and must not use Panderr in a way that interferes with the
operation, security, or availability of the service.
3. Your websites and content
You retain ownership of the website content, business information,
images, text, files, trademarks, logos, and other materials that you
provide to Panderr, subject to any rights belonging to third parties.
You grant PeachSites, LLC permission to access, retrieve, copy,
process, reproduce, transform, store, transmit, render, export, and
publish that content as reasonably necessary to provide the Panderr
services you request.
This permission exists only to allow us to operate Panderr and provide
requested services and does not transfer ownership of your content to
PeachSites, LLC.
4. Your responsibility for submitted websites and content
You are responsible for ensuring that you have all rights,
permissions, licenses, or authorization necessary to submit a website,
URL, ZIP file, content, images, documents, trademarks, logos, code,
files, and other materials to Panderr.
By asking Panderr to inspect, reproduce, migrate, improve, redesign,
edit, export, or publish a website, you represent that you own the
website or have authorization from the website owner to perform the
requested work.
You may not use Panderr to copy, migrate, reproduce, or publish a
website or other content that you do not have authority to use.
5. Website migration, preservation, improvement, and redesign
Panderr provides tools intended to help users preserve, improve,
redesign, edit, export, and publish websites.
Website migration may involve differences between hosting
environments, content-management systems, proprietary platforms,
browsers, third-party applications, scripts, databases, forms,
fonts, integrations, analytics tools, payment systems, and other
technology.
While Panderr is designed to reproduce and preserve website content
and presentation where appropriate, exact reproduction of every
feature, integration, behavior, appearance, or third-party service
cannot be guaranteed.
You are responsible for reviewing migrated, generated, redesigned, or
edited websites before publishing them and confirming that the
resulting website meets your requirements.
6. Editing, previewing, publishing, and domains
Panderr may provide tools for editing, previewing, exporting, hosting,
publishing, or connecting websites to custom domains.
Publishing may depend on third-party infrastructure, hosting
providers, domain registrars, DNS providers, APIs, or other services
outside the direct control of PeachSites, LLC.
You are responsible for reviewing a website before publication,
maintaining appropriate domain ownership and access, and ensuring that
any information or content you publish is accurate and lawful.
7. Accounts and security
You are responsible for maintaining the confidentiality of your
account credentials and for activity occurring through your account.
You should use reasonable security measures to protect your login
information and promptly notify us at

if you believe your account has been accessed without authorization.
We may restrict or suspend access when reasonably necessary to protect
Panderr, our users, third parties, or the security and integrity of
our systems.
8. Third-party services
Panderr may use, integrate with, or link to third-party products and
services, including hosting providers, infrastructure providers,
domain registrars, payment processors, authentication providers,
email services, analytics services, APIs, and other technology
providers.
Your use of third-party products or services may be governed by
separate agreements, terms, fees, and privacy policies established by
those providers.
PeachSites, LLC does not control third-party services and is not
responsible for interruptions, changes, limitations, or failures
caused by services outside our control.
9. Fees, purchases, and payments
Prices, billing terms, included services, subscription terms, and
other purchase details are presented when you purchase or subscribe
to a Panderr product or service.
You agree to pay applicable charges associated with the products or
services you select.
Payments may be processed by third-party payment providers. PeachSites,
LLC may not directly receive or store complete payment-card
information when payments are handled by those providers.
Any refund, cancellation, renewal, or subscription terms presented at
the time of purchase are incorporated into these Terms.
10. Acceptable use
You may not use Panderr to:
- Violate applicable law or regulation.
- Infringe intellectual-property or other rights of another person.
- Copy or migrate websites you are not authorized to use.
- Distribute malware, malicious code, or harmful software.

Attempt to gain unauthorized access to accounts, systems,
infrastructure, or data.

Interfere with or disrupt Panderr, its infrastructure, or other
users.

Use automated systems in a manner that imposes an unreasonable or
harmful load on the service.

Use Panderr for fraudulent, deceptive, abusive, or unlawful
activity.
We may restrict or terminate access to Panderr when we reasonably
believe these rules have been violated.
11. Intellectual property and the Panderr platform
Except for content provided by users or third parties, Panderr and its
software, interfaces, branding, designs, documentation, workflows,
technology, and other platform materials are owned by or licensed to
PeachSites, LLC and are protected by applicable intellectual-property
laws.
These Terms do not grant you ownership of the Panderr platform,
Panderr branding, PeachSites branding, or the underlying software and
technology used to provide the service.
12. Service availability and changes
Panderr is an evolving product. We may add, modify, replace, limit,
suspend, or discontinue features or portions of the service over time.
We work to provide reliable access to Panderr but do not guarantee
uninterrupted, continuously available, or error-free operation.
Maintenance, software updates, third-party outages, security events,
infrastructure failures, or circumstances outside our control may
temporarily affect availability.
13. Suspension and termination
You may stop using Panderr at any time.
We may suspend or terminate access to Panderr when reasonably
necessary because of a violation of these Terms, unlawful activity,
security concerns, nonpayment, abuse of the service, or conduct that
could harm Panderr, PeachSites, LLC, another user, or a third party.
Certain provisions of these Terms that by their nature should survive
termination, including provisions concerning ownership, payment
obligations, disclaimers, and limitations of liability, will continue
to apply after termination where permitted by law.
14. Disclaimers
Panderr is provided on an “as available” and “as is” basis to the
extent permitted by applicable law.
We do not guarantee that Panderr will meet every individual
requirement, reproduce every website or third-party feature exactly,
operate without interruption, or be free from all errors or technical
limitations.
To the extent permitted by law, PeachSites, LLC disclaims warranties
that are not expressly stated in these Terms.
15. Limitation of liability
To the extent permitted by applicable law, PeachSites, LLC, including
through the Panderr product and services, will not be liable for
indirect, incidental, special, consequential, exemplary, or punitive
damages, or for loss of profits, revenue, data, goodwill, business
opportunity, or anticipated savings arising from or related to use of
Panderr.
To the extent permitted by applicable law, the total liability of
PeachSites, LLC arising from or relating to Panderr will not exceed
the amount you paid to PeachSites, LLC for the Panderr product or
service giving rise to the claim during the twelve months immediately
preceding the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations of
liability, so some of these limitations may not apply to you.
16. Privacy
Our collection and use of personal information in connection with
Panderr is described in our
Privacy Policy.
17. Changes to these Terms
We may update these Terms as Panderr, our business, or applicable
legal requirements evolve.
When these Terms are updated, we will revise the “Last updated” date
above. Where appropriate, we may provide additional notice of material
changes.
Your continued use of Panderr after updated Terms become effective
constitutes acceptance of the revised Terms where permitted by
applicable law.
